The question of reselling iPhones worries many people. Some really want to resell iPhones to make money on it, and some might have seen an iPhone at a discount and are now thinking of buying it to sell it for a little more.
In fact, there can be so many scenarios where you need to resell your iPhone, so you have to know how legal it is.
Is it illegal to buy new iPhones to resell them for a profit?
Note: This answer isn’t professional legal advice and doesn’t create any attorney-client relationships.
So you want to buy iPhones to resell them for a profit. I will tell you right away that this is perfectly legal, because there is no law which prohibits you to sell your property for any price a potential buyer would be willing to buy it for (if we are talking about the common goods market, of course).
However, there are a few things you should keep in mind:
- If you didn’t pay the full price of the iPhone, for example, you bought it with a contract from the carrier, it could be a breach of the purchase agreement with the carrier. In that case, you cannot sell the iPhone until you fulfill the terms of the contract.
- If you are not an authorized Apple reseller, in case you resell iPhones, especially to another country, people who buy iPhones from you may lose the warranty.
- If you want to resell iPhones to another country, it could be a violation of the Export Act. So you also need to check this point, but it depends on the country or state where you buy the iPhone.
